How Do You File a Nursing Home Abuse Complaint in Illinois?

The Illinois Department of Public Health (IDPH) is the primary agency for nursing home complaints in Illinois. Filed complaints will be reviewed by the IDPH and may result in an investigation under Illinois Administrative Code Chapter I Section 400.120

Ways to file a complaint with the IDPH include:

  • Online via the IDPH Health Care Facilities Complaint Form on their website

  • The IDPH Nursing Home Hotline at 1-800-252-4343, which is staffed 24 hours a day, 7 days a week

  • Faxing or mailing the Health Care Facilities Complaint Form to the IDPH Central Complaint Registry in Springfield

Complaints can be made anonymously. If you do specify who you are, the IDPH won't reveal your identity without your permission. If you provide contact information, the IDPH will also notify you of the outcome of their investigation. The facility where your loved one lives is legally prohibited from retaliating against you or your loved one for filing.

IDPH is required to begin investigating all complaints within 30 days. If the situation involves an immediate threat to a resident's life or safety, the investigation must begin within 24 hours. When violations are confirmed, the IDPH can issue fines, require corrective action plans, or refer the matter for civil or criminal enforcement.

Does the Illinois Government Offer Compensation After a Nursing Home Abuse Complaint?

Filing an IDPH complaint is an important step. However, it won't directly compensate your family for what happened. A government investigation can hold a facility accountable and potentially lead to penalties, but those penalties go to the state, not to you.

If your loved one was harmed in their nursing home, the Illinois Nursing Home Care Act gives families the right to file a separate civil lawsuit against the facility. Illinois generally requires that civil claims for nursing home abuse or neglect be filed within two years of the date of the injury.
